Who enforces health and safety legislation at my workplace?

Health and safety legislation is enforced by authorised officers of either the Health and Safety Executive or the council.

As enforcing authorities each deal with different sectors.

Health and Safety Executive

The Health and Safety Executive (HSE) advise and enforce on:

  • general agricultural;
  • construction;
  • manufacturing issues;
  • council premises.

The council

The council give advice and enforce regulations in:

  • offices;
  • hospitality trade;
  • retail and wholesale;
  • residential care;
  • consumer services including leisure businesses.

How do I complain about health and safety at my workplace?

If you think the condition of your workplace is putting your safety at risk or damaging your health, you should raise your concerns with your employer or person in control of the premises.

If no improvement is made and your safety or health continues to be at risk, then you can report your complaint to the relevant enforcing authority and ask them to look into it.

To make a complaint in relation to your workplace, where the Health and Safety Executive is the appropriate enforcing authority;

Out-of-hours contact details

Where the council is the appropriate enforcing authority and the complaint or concern is regarding;

  • A fatal accident at work.

  • A major injury at work i.e. amputation of a limb, fracture of a limb.

  • A major dangerous occurrence at work i.e. collapse of scaffolding, overturning of a crane, forklift truck or collapse of freestanding racking.

  • A workplace complaint in respect of serious or dangerous practices i.e lack of fall protection equipment and happening at that time.
