Information about the East Riding Local Plan; a suite of planning documents that together will provide the framework for managing development and addressing key planning issues in the East Riding.

What is an Examination in Public?

As part of the process of preparing a Local Plan, each document within the plan is subject to an ‘Examination in Public’. This is a form of public inquiry where an independent planning inspector, appointed by the Secretary of State, will ‘test’ the document to see if it meets the requirements of the relevant legislation and to see if it is ‘sound’. Soundness is tested by considering whether the document is justified; effective and consistent with national policy.

The council has proposed a further modification to the site SMB-B (Land North of A166, Stamford Bridge) in the Allocations Document. This is set out in the East Riding Local Plan Additional Schedule of Modifications (Allocations Document) January 2016 (CD388) and is accompanied by a revised Habitats Regulations Assessment and Sustainability Appraisal Note (CD389).  The consultation period for comments on the modifications starts on Monday 18 January 2016 and closes at 5pm on Monday 29 February 2016. The documents, together with details on how to comment on the modifications can be found under the question 'What changes are proposed for the East Riding Local Plan?'.

Please note that the Inspector has advised that he may not be able to take into account any further submissions relating to any further matters. Comments relating to the principal of the allocation or other aspects or content of the Plan should not be submitted to the Inspector.

The Inspector has issued a letter regarding the timescale of the reports. The letter from the council and the Inspector has been added to the  examination library (CD386 and CD387). The Inspector is finalising his report and does not need any further representations.

What documents have been submitted for examination?

A number of documents were submitted to the Secretary of State on 29 April 2014, including:

What is the examination library?

The examination library comprises the suite of documents which form the background and evidence base for the Submitted Strategy and Allocations Documents. The library includes the submitted documents in the above table (CD01 to CD34) and those set out in the table below.

What changes are proposed for the East Riding Local Plan?

Following consultation on the Local Plan Modifications in March 2015, the council has proposed a further  modification (reference: AM242) to site SMB-B (Land North of A166, Stamford Bridge) in the Allocations Document.  This has been proposed to address comments raised by National England on the Local Plan Habitats Regulations Assessment.

The Modification takes into account an update of the site assessment for SMB-B, as well as a revised Habitats Regulations Assessment  and Sustainability Appraisal Notes (CD389) for the site. These have been reflected in a Statement of Common Ground (CD366/02) that has been prepared by the council and Natural England.

The consultation will commence on Monday, 18 January 2016 and will close at 5pm on Monday, 29 February 2016.

The public consultation took place between Monday 30 March 2015 to 5pm on Monday 11 May 2015. Comments were only invited on the changes (modifications) and on new documents that were added to the examination library since the hearing sessions. These documents included a note on the impacts of the 2012-based household projections (see CD346 below) which were released by the Department of Communities and Local Government on 28 February 2015.

Responses to the changes (March 2015)

A number of comments on the proposed modifications were sent to the Programme Officer on behalf of the Planning Inspector. These are set out in the table below and are provided with the prefix 'FC' to distinguish them from previous responses to the Local Plan.

The Planning Inspector will now consider the responses for both Examinations (Strategy Document and Allocations Document) before deciding on the next steps in the process. No further responses are required and any which are received will be returned without being considered. 

The table below also includes responses to modifications first set out in July 2014 following the submission of the Strategy and Allocations Documents. The modifications were detailed in document CD04/02 and were subject to public consultation between 21 July 2014 and 1 September 2014. The responses to that set of modifications are provided with the prefix 'EMM' in the table below.

When will the Examination in Public take place?

The Examination is currently ongoing. The first set of hearing sessions for the examination of the Strategy Document started on Tuesday, 7 October 2014 and for the Allocations Document on Tuesday, 4 November 2014. Both sessions were closed by the inspector on the 18 November.

Following the consultation on the Schedule of Modifications (March 2015), the Inspector requested further hearing sessions for the Allocations Document. The additional hearing sessions took place on Tuesday, 14 July and Wednesday, 15 July 2015. These additional sessions were to discuss modifications to the Allocations Document only, specifically where they extend or reduce sites already proposed by the council, and where the council seeks to introduce new sites or remove others from the plan.

What 'matters and issues' were discussed at the hearing sessions?

The planning inspector prepared two 'matters and issues' papers, one for each examination.  Because of the nature of the two documents and their parallel examinations, there was some overlap, so the matters and issues papers should be read together.  The matters and issues papers are available to view below, together with guidance notes for people participating in the examinations.

Representatives, including the council, were invited to submit written statements to address the matters and issues the inspector has identified. These were submitted to the Programme Officer by 5 September 2014 and are set out in the table below.

Who do I contact for more information?

An independent programme officer has been appointed to represent the planning inspector. The programme officer is responsible for managing the day to day arrangements of the examination process before and during the period of the examination, recording all documents submitted, arranging for the inspection of sites by the inspector and dealing with correspondence on his behalf to those have made representations, including requests for and exchange of all statements. This will include any communication or correspondence between the inspector and the council.
